TERMS and CONDITIONS

The following definitions apply within these Terms and Conditions
BUNTERS means BUNTERS Ltd
The Client means the family requiring an Au Pair
Applicants means the candidate Au Pairs
No variation in these Terms and Conditions is binding upon BUNTERS unless the Managing Director - Mrs Caroline Jones, has agreed the variation.
  1. BUNTERS cannot be held responsible in any way for the character and suitability of any Applicant, accuracy of references, medical certificates and personal details supplied by the Applicant and is hereby expressly excluded from all liability whatsoever directly or indirectly arising from the placement of an Applicant. BUNTERS is an Introduction Agency only, whilst reasonable effort is taken to introduce suitable candidates, it is the Client's final responsibility as to whether an Applicant should be offered a position.
  2. BUNTERS shall not be liable under any circumstances to the Client in respect of any loss, damage, cost, expense, injury, death or inconvenience incurred to any persons or property arising from any act or omission on the part of the Applicant before or after engagement by the Client.
  3. The Client will forfeit any fee paid to BUNTERS if they:
    • fail to adhere to these Terms and Conditions, or
    • negotiate independently with our Applicant.
  4. All introductions are confidential, should a Client directly, or indirectly introduce an Applicant to another family, the original family will be liable for the full Placement Fee should an engagement result. The Client will be liable for the full placement fee for any Au Pair engaged as a consequence of, or resulting from, an application to BUNTERS even though the introduction is made indirectly.
  5. After the Client has spoken to the Applicant on the telephone and the Client has accepted the Applicant, the Client shall provide to BUNTERS:
    1. an Invitation Letter and
    2. BUNTERS Placement Fee according to the expected duration of the engagement.
    BUNTERS will reserve, on the basis of a telephone call, a selected Applicant for the Client for four working days only. If BUNTERS do not receive items a) and b) above within the four days, the Applicant will be offered to other Clients for selection.
  6. The Client will allow the Applicant to take one week's paid holiday for every 26 weeks that the Applicant is with the Client. The Applicant must be paid pocket money by the Client whilst left on their own, due to the Client being on holiday. The Client must also provide heating food, for the Applicant during any period that they have been left on their own.

REFUNDS and REPLACEMENTS POLICY

  1. The Client shall inform BUNTERS of the agreed start date of the engagement. BUNTERS cannot guarantee that the selected Applicant will actually start their period of engagement with the Client or that they will stay for the required length of engagement. In these circumstances, the following conditions apply:
    1. If the Client has not honoured these Terms and Conditions or the Au Pair has left because the Client has asked them to work longer than the agreed hours or undertake duties not previously agreed with them, then the Client will not be entitled to a Refund or Replacement.
    2. If BUNTERS is unable to place the selected Applicant with the Client e.g. the Au Pair cancels, through no fault of the Client, a replacement will be sought or a full refund given, whichever BUNTERS in it's absolute discretion thinks fit.
    3. If the Client cancels an engagement after it has been confirmed and before the scheduled arrival of the Applicant, BUNTERS will charge a standard fee of £50 to the Client and the Client shall return all documents to BUNTERS.
    4. If the Applicant introduced by BUNTERS and engaged by the Client leaves within four weeks of the start of the engagement, BUNTERS shall attempt to replace the Au Pair for the Client. BUNTERS will be given one month, from the date of termination to provide a replacement. If during this period, the Client makes alternative arrangements or requests "No Replacement", and then NO REFUND WILL BE DUE. Otherwise, if BUNTERS is unable to find a suitable replacement within one month, BUNTERS shall refund to the Client a proportion of the placement fee actually paid by the Client. If the Applicant leaves within 2 weeks, the proportion shall be 50 %. If the Applicant leaves within week 3 or 4 of the engagement, the proportion shall be 30 %.
    5. NO REFUND will be due from BUNTERS to the Client, if a Replacement Au Pair is terminated.
    6. If the Au Pair stays longer than 4 weeks from the agreed start date of the engagement, the engagement is regarded as satisfactory and BUNTERS shall have fulfilled its obligations.
    7. A minimum of 7 days notice of termination of engagement must always be given by the Client to the Au Pair, the Client must ensure that the Au Pair has somewhere suitable to stay and BUNTERS must be notified immediately. Clients who dismiss Au Pairs without notice will forfeit any Refund and will be liable for any expenses incurred by BUNTERS and/or the Au Pair.
